The Australian Communications and Media Authority (ACMA) has applauded a recent Federal Court ruling against Phaze Broadcasting Pty Ltd for breaching the Radiocommunications Act 1992. The Court found Phaze was operating unlicensed transmitters, resulting in a fine of $8,000. Additionally, the ruling included the forfeiture of three transmitters and an injunction against further breaches.
The case stemmed from Phaze’s use of unlicensed addresses in Ballarat, Victoria. These addresses were different from those specified in its licenses. This action violated Phaze’s low-power open narrowcasting (LPON) license. The license mandates operation from specified locations to avoid interference with other devices.
Justice O’Callaghan emphasized the importance of compliance with licensing regimes. Such compliance protects the spectrum for commercial, defense, national security, and community purposes. LPON services must operate only from locations specified in their licenses.
