    IFT updates regarding COVID-19

    The IFT announces suspension of deadline and terms:

    Given the health situation that is registered in our country due to the Coronavirus pandemic, it was agreed to suspend terms and deadlines for matters related to telecommunications and broadcasting from March 23 to April 19, with some exceptions to processes that can be carried out electronically.
    The above in accordance with the recommendations made by the Federal Government regarding healthy distance to avoid the dispersion of COVID-19 in crowded places such as the Institute’s facilities.

    Given the health situation that is registered in our country due to the Coronavirus pandemic (COVID-19), the Plenary of the Federal Telecommunications Institute (IFT), agreed to suspend, due to force majeure, terms and deadlines for matters regarding telecommunications and broadcasting from March 23 to April 19.

    The foregoing, in accordance with the recommendations made by the Federal Government regarding healthy distances to avoid dispersion of COVID-19 in crowded places, such as the Institute’s facilities.

    In accordance with the agreement approved today by the Plenary, from March 23 to April 19, 2020, in terms of article 28 of the Federal Administrative Procedure Law, due to force majeure, the terms and deadlines regarding telecommunications and broadcasting, with the exception of some matters and procedures, considering that these are matters that are dealt with through the electronic means of communication or can be dealt with in this way, and are highly important for the daily development of the industry; as well as supervision and verification actions that could be carried out to maintain the continuity of the telecommunications and broadcasting services.

    Among them are:

    Application for registration of tariffs to the public for telecommunications services in the Public Registry of Concessions, through the Electronic System of Registry of Tariffs.

    Electronic request for authorization of rates for telecommunications services for end-users, applicable to the predominant economic agent and economic agents with substantial market power in the telecommunications sector.
    Application for registration in the Public Registry of Concessions.
    Request for authorization of assignment of geographic and non-geographic numbering rights.
    Presentation of nonconformities related to the provision of telecommunications services.
    Attention to harmful interferences and other irregularities and disturbances that arise between the systems used for the provision of telecommunications and broadcasting services.

    The contracting procedures related to public tenders and invitations to at least three people in the area of ​​acquisitions, leases and services, until the operation of the government’s electronic system of public information on acquisitions, leases and services is formally suspended. Federal Public Administration (CompraNet), or, the Plenary of the Institute, in its case, agrees the general suspension of work.

    In terms of economic competition, the terms and deadlines of all procedures, actions, investigations and procedures in this area for the telecommunications and broadcasting sectors will also be suspended from March 23 to April 19, 2020.

    The Official Parts Office of the Institute will continue to receive documentation in working days and hours, in accordance with the Annual Calendar of Ordinary Sessions and the Annual Calendar of Work for the year 2020 and early 2021, published in the Official Gazette of the Federation on September 11, December 2019; however, the processing and handling of matters will be carried out in accordance with the provisions of the Agreement approved today.

    It is important to reiterate that the actions taken by the Plenary do not imply a suspension of work, since the Plenary will continue to meet. However, it is the duty of the IFT to collaborate, promote and implement preventive measures, consistent with the recommendations of the Federal Government regarding healthy distance. In this sense, Telework actions will be implemented, which does not imply the suspension of work of the personnel, nor the exception to the performance of functions, as has been proven through the successful experience in meeting the objectives of the administrative units that have participated in this work scheme since it began to be implemented at the Institute five years ago.

    On December 11th, 2023, the head leader of Cambodia's Telecommunication Regulator of Cambodia (TRC) issued a notification to all officers regarding the review of type approval documents, emphasizing the importance of consistency between the information provided in test reports and that submitted by clients. Moreover, TRC explicitly stated that reports lacking any indication of country of origin will not be accepted under these new guidelines. This adjustment aims to enhance accuracy and consistency in reviewing type approval submissions.     Malaysia SIRIM-MCMC Regulatory Updates

    The Malaysia SIRIM CMCS Department, responsible for MCMC certification, recently implemented a significant update regarding Intellectual Property (IP) Forms for Type Approval applications. These forms replace the trademark authorization letter to improve efficiency and accuracy in approvals. The new IP Forms categorize trademark declarations based on whether the applicant has obtained authorization from the trademark/brand owner. For applicants who have been authorized, the required documents include evidence of a registration certificate issued by the Intellectual Property Corporation of Malaysia (MyIPO). Or an equivalent foreign organization, along with an Intellectual Property (IP) Authorization Letter (eTAC/FOR/01-8). On the other hand, if the applicant has not obtained written consent and authorization to use the trademark/brand, they must submit the Intellectual Property (IP) Undertaking form issued by the applicant (eTAC/FOR/01-9). Importantly, these new forms are effective immediately and will be used for all new projects. They mark a significant shift in SIRIM's approach. The organization can now accept brands/trademarks that have not been officially authorized by the brand owner. However, in such cases, the importer must provide a written declaration accepting responsibility. Furthermore, the new Brand name authorization process requires both the Brand owner and the Importer to co-sign the Brand name authorization letter. This updated procedure aims to enhance transparency and accountability in the approval process for Type Approval applications, ultimately benefiting both applicants and consumers in Malaysia.     India TEC issued a notification in January 2024 regarding generic exemptions for products without available test labs.  In January 2024, India's Telecommunications Engineering Centre (TEC) issued a significant notification regarding generic exemptions due to the absence of available test laboratories within the country. It's important to note that while these exemptions are in place, ILAC reports for CE/FCC are still subject to regulations based on the specific product category. Notably, the validation for these exemptions has been extended until June 30, 2024, with the potential for further extensions based on the evolving circumstances.
